Police use Taser gun on man who punched them
A JUDGE on Wednesday warned violence against the police would not be tolerated after officers used a Taser gun to arrest a Spalding man who assaulted them.
Lincoln Crown Court heard how Matthew Dye (21) repeatedly punched two officers after they were called to an assault at his flat in Acacia Avenue.
The court was told Dye had been asked to leave the flat he shared with partner, Charmaine Grogan, after she made a silent 999 call.
Sam Skinner, prosecuting, said two officers were forced to go back to the flat when Dye returned a short time later and assaulted Miss Grogan.
Mr Skinner said Dye grabbed Miss Grogan by the throat, threw her onto a bed and put his knee into her stomach while pulling at her hair.
Both officers were repeatedly punched when they tried to arrest Dye. Mr Skinner added: “CS spray was used but it had no effect on him at all.”
Dye was eventually rugby tackled by one of the officers who “tasered him in the back.” Dye continued to struggle so had to be tasered a second time.
The court heard both officers suffered injuries including bruising and swelling, a cut lip and loose tooth.
The court heard Dye had been on remand in prison for 197 days since the offences.
Dye admitted two charges of assault with intent to avoid arrest and common assault on July 24.
He was sentenced to a two-year community order, placed under the supervision of a probation officer for two years and ordered to complete a domestic violence course.
Passing sentence Judge Sean Morris admitted his “hands were tied” as Dye had already served the equivalent of a 12 month prison term.
Judge Morris told him: “I will not tolerate violence towards the police. Had you not been in prison all this time you would definitely be receiving a prison sentence.”
