£110,000 unpaid council tax and business rates
SOUTH Holland District Council won liability orders on Tuesday to recover more than £110,000 owed in unpaid council tax and business rates.
Some 147 people had failed to pay council tax amounting to a total of £84,257.70. Further orders were granted by Spalding magistrates to help the council recover more than £25,801.55 in business rates owned by seven firms.
The council takes debtors to court on a monthly basis to win liability orders, which provide extra powers for recovering sums such as a deduction at source from benefits or calling in bailiffs.
Coun Paul Przyszlak, district council portfolio holder for strategic finance, said: “We have a duty to those who do pay their council tax and business rates by bringing to book those who are in default. If anyone is having problems paying they should contact us as soon as possible. There is advice available for those who are genuinely struggling to pay.”
The council has also brought proceedings against Julian and Jane Davis, now of Mayfair Drive, Spalding, who are alleged to owe two amounts – £1,009.99 and £253.75 in council tax and costs – for the house they quit at Deeping St Nicholas because of noise from wind turbines.
Council debt recovery specialist Lee Learwood-Griffiths asked magistrates to adjourn the hearing to December 6.
Mr and Mrs Davis are fighting a High Court action against four wind farm turbine owners and operators over alleged “nightmare” noise that they say drove them out of their home.
Some evidence has been heard. The case is due to resume in November.
Mr Learwood-Griffiths said the district valuer has the power to take their former home off the list so council tax no longer falls due – but the case can only be pursued by Mr and Mrs Davis. He told magistrates Mr and Mrs Davis are paying council tax for their current home.

Saturday, September 17, 2011 at 01:21 PMLike x.o. I question why Mr & Mrs. Davis have been singled out when 146 indviduals and 7 businesees have not paid either. At least Jane and Julian have a good reason for not paying theirs - can the same be said for the rest. Simple answer to this of course is for the council to send the bill to the landowners who greedily agreed to have the turbines on their land and ask them to pay the bill.! Good luck to Jane and Julian you have many supporters out here.

Friday, September 16, 2011 at 02:14 PMWhy oh why should Mr and Mrs Davies pay their council tax when it was the council that approved the application that has seen them having to leave their home!!!!! Im sure I wouldnt pay it either... As above, where is the list of the other people who have failed to pay their council tax? Seems nothing less than bullying against a family who have suffered years of abuse from various government bodies as well as developers and landowners!!!

Friday, September 16, 2011 at 12:41 PMSo, where can the list from South Holland District Council be found detailing the other 146 individuals and 7 businesses who have failed to pay their council tax - itemising amounts and reasons for thier failures to pay? In the interests of fairness, let's put them all in the public domain, not just one, and then evaluate legitimate reasons or not for non payment.
